Please read these Terms of Use carefully before using Where Is My Dude. By downloading, installing, or using this application, you agree to be bound by these terms. If you do not agree, do not use Where Is My Dude.
1. Acceptance of Terms
By accessing or using Where Is My Dude (“the App”, “the Service”), you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to comply with all applicable local, national, and international laws and regulations.
2. Description of Service
Where Is My Dude is a voluntary, consent-based family location sharing tool. It allows users to share their real-time GPS location, device information, and battery status with designated family members. The App is intended solely for lawful, consensual use among family members or individuals who have explicitly agreed to share their information.
3. Consent Requirement — CRITICAL
This is the most important section of these Terms. You MUST read and comply with the following:
3.1 Mandatory Consent
Where Is My Dude may ONLY be used with the full, informed, and voluntary consent of every person being tracked or monitored. Before using this App to monitor any individual, you must:
- Clearly explain to that person what data will be collected
- Explain who will have access to that data
- Explain how and where that data will be transmitted and stored
- Obtain their explicit, freely given consent before activating any sharing
- Ensure they know how to stop sharing at any time
3.2 Prohibited Covert Use
It is STRICTLY PROHIBITED to use Where Is My Dude to monitor, track, or surveil any person without their full knowledge and consent. This includes but is not limited to:
- Installing or activating the sharing feature on another person’s device without their knowledge
- Using the App to monitor a spouse, partner, or family member without their explicit consent
- Using the App to monitor employees, tenants, or any non-family members
- Using the App as a tool for stalking, harassment, domestic abuse, or coercive control
Covert surveillance using this App is illegal in most jurisdictions worldwide and may result in serious criminal penalties including imprisonment. KentDevTools bears no responsibility for any illegal use of this software.
4. Lawful Use Only
You agree to use Where Is My Dude only for lawful purposes and in a manner that does not infringe the rights of others. You are solely responsible for ensuring your use of the App complies with all applicable laws in your jurisdiction, including but not limited to:
- Privacy and data protection laws
- Electronic surveillance and wiretapping laws
- Domestic violence and stalking laws
- Laws governing monitoring of minors
5. Data Collection & Privacy
5.1 Data Collected
When the sharing feature is activated by the user, the App may collect and transmit the following data:
- Real-time GPS location coordinates
- Location accuracy and timestamp
- Device model and operating system version
- Browser and platform information
- Network connection type
- Screen resolution and device pixel ratio
- Device language and timezone
- Battery level and charging status
- User agent string
5.2 Data Transmission
Location and device data is transmitted in real-time over an encrypted connection to a third-party relay service (HiveMQ public MQTT broker). KentDevTools does not operate, own, or control this relay service. Users should review HiveMQ’s own privacy policy at hivemq.com.
5.3 Data Retention
KentDevTools does not store, log, or retain any location or device data transmitted through the App. All data is relayed in real-time between devices and is not saved on any KentDevTools servers.
5.4 Third-Party Services
The App uses the following third-party services which have their own privacy policies:
- HiveMQ Public MQTT Broker — data relay
- OpenStreetMap — map tile rendering
- Google Fonts — typography
6. Intellectual Property
Where Is My Dude and all associated code, design, and documentation are the intellectual property of KentDevTools. Purchase of a license grants you a non-exclusive, non-transferable right to use the App for personal or commercial purposes in accordance with the license purchased. You may not:
- Resell, redistribute, or sublicense the source code without written permission
- Remove or alter any copyright or proprietary notices
- Reverse engineer or create derivative works without written consent
7. Disclaimer of Warranties
Where Is My Dude is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied. KentDevTools does not warrant that the App will be uninterrupted, error-free, or completely secure. GPS accuracy depends on the device and network conditions and may vary.
8. Limitation of Liability
To the maximum extent permitted by applicable law, KentDevTools and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Any harm resulting from unauthorized or illegal use of the App
- Loss of data or privacy breaches caused by third-party relay services
- Inaccurate location data
- Any criminal or civil liability arising from misuse of the App
9. Indemnification
You agree to indemnify, defend, and hold harmless KentDevTools, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including legal fees) arising out of or in any way connected with your use or misuse of the App, your violation of these Terms, or your violation of any applicable law.
10. Modifications to Terms
KentDevTools reserves the right to modify these Terms at any time. Updated Terms will be posted on kentdevtools.com with a revised effective date. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KentDevTools operates. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
